Scope of this Policy

This Privacy Policy explains how 98point6 Inc. (“98point6,” “we,” or “us”) collects, uses, and discloses information about you when you visit our websites, contact our customer support team, or otherwise communicate with us outside the context of seeking medical care. In this Privacy Policy, we also explain our practices related to certain information that is automatically collected when you download the 98point6 mobile app (“App”).  

This Privacy Policy does not govern privacy practices with respect to any individually identifiable health information (also referred to as “Protected Health Information” or “PHI”). 98point6 treats all information you provide in connection with seeking or receiving medical care as PHI. For example, PHI includes all communications through our App, account credentials associated with our App, and any other information you choose to share via the App, such as photos or descriptions of health symptoms. The 98point6 Notice of Privacy Practices describes how our affiliate, 98point6 Physicians Professional Corporations, uses, maintains and shares your PHI, as well as your rights with respect to your PHI. Updates to this Policy

We may update this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, we may provide you with additional notice (such as adding a statement to our homepage or sending you a notification). We encourage you to review this Privacy Policy and the 98point6 Notice of Privacy Practices frequently to stay informed about our information practices and the choices available to you.

Collection of Information

Information You Provide to Us

We collect information you provide directly to us. For example, we collect information when you provide your phone number via our website to download our App, fill out a form, register for a User Account on the 98point6 Online Portal for commercial customers, register for and participate in a webinar or survey that we offer, request a demo, submit a request for customer support, join our Primary Care Council (“PCC”), apply for a job, communicate with us via third party social media sites, or otherwise communicate with us outside of the context of seeking or receiving medical care. The types of information we may collect include contact information such as your name, phone number and email address, as well as information you share with us during webinars, demos, or communications with our customer services team. If you apply for a job with us or participate in our PCC, we will collect application information from you, such as certain demographic information as well as your resume or details about your medical practice and work history.

 The websites are not intended for the exchange of medical information. However, to the extent you provide medical information through a channel other than via our App (such as through a form on one of our websites), we will treat such information as PHI, subject to our Notice of Privacy Practices.

Log and Device Information

We collect log information about your use of our websites, including the type of browser you use, links clicked, access times, pages viewed, your IP address and the page you visit before navigating to our websites. We collect information about the computer or mobile device you use to access our website or to which you download our App, including the hardware model, operating system and version, unique device identifiers, App version, and mobile network information.

Information Collected by Cookies and Other Tracking Technologies

We (and our service providers) use various technologies to collect information, including cookies and web beacons. Cookies are small data files stored on your hard drive or in device memory that help us improve our websites and your experience using it, see which areas and features of our websites are popular, and count visits. Web beacons are electronic images that may be used on our Website or in emails and help deliver cookies, count visits, understand usage and campaign effectiveness. Information We Collect From Other Sources

We may also obtain information from other sources and combine that with the information we collect through our websites. For example, we may collect information about you from third parties, such as, for job applicants, information from identity or credential verification services or.

We may allow others to provide analytics services and serve advertisements on our behalf across the Internet. These entities may use cookies, web beacons, device identifiers and other technologies to collect information about your use of our websites and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in apps, links clicked and conversion information. This information may be used by 98point6 and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on other websites and better understand your online activity. 98point6 is based in the United States and the information we collect is governed by U.S. law. Therefore, if you access or use our websites, or otherwise provide information to us, we may transfer and store such information in and to the U.S. and other countries, where you may not have the same rights and protections as you do under local law.

Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of parts of our websites. You may opt out of receiving promotional emails from 98point6 by following the instructions in those emails. If you opt out, we may still send you non-promotional emails, such as those about any active requests or our ongoing business relations.

Your California Privacy Rights

The California Consumer Privacy Act (“CCPA”) provides California residents with certain rights with respect to their personal information. If you are a California resident, this section applies to you. Please note that the CCPA does not extend to PHI collected by health providers like 98point6. For details about our information practices and how to exercise your rights with respect to PHI, including how to request access to your medical record, please review our Notice of Privacy Practices.

With respect to information that is covered by the CCPA, in the preceding 12 months, we have collected the following categories of personal information: identifiers (such as your name, telephone number and email address if you apply for a job or create a user account for the 98point6 Online Portal), characteristics of protected classifications (such as your age and gender), internet and other electronic network activity information, audio information (such as recordings of customer service calls), professional and education information (such as if you apply for a job with us), and inferences (such as the city you live in based on your IP address). For details about the precise data points we collect and the categories of sources of such collection, please see the Collection of Information section above. We collect personal information for the business and commercial purposes described in the Use of Information section above. California law requires that we provide transparency about personal information we “sell,” which, for the purposes of the CCPA, broadly means scenarios in which 98point6 has shared personal information with third parties in exchange for valuable consideration. We do not sell any of your Protected Health Information or any directly-identifying information. For purposes of California law, we “sell” the following categories of personal information to the following categories of third parties for the commercial purpose of advertising our products and services:

You have the right to opt out of these sales at any time by visiting our “Do Not Sell My Personal Information” webpage. We do not sell personal information about consumers whom we know to be under the age of 16.  

In addition to your right to opt out of “sales” outlined above, subject to certain exceptions and limitations, you have the right to (1) request to know more about the categories and specific pieces of personal information we collect, use, and disclose, (2) request deletion of your personal information, and (3) not be discriminated against for exercising these rights. You may make these requests by visiting our Contact Us form (select “consumer data request” from the first drop-down) or emailing us at privacy@98point6.com. We will verify your request by asking you to follow instructions in correspondence from us. We will not discriminate against you if you exercise your rights under the CCPA.

If we receive your request from an authorized agent, we may ask for evidence that you have provided such agent with a power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf.
